ABUSE IN BANKRUPTCY PROCEEDINGS AS A CHALLENGE TO THE LEGAL ORDER

Abstract (English):
The article examines criminal bankruptcies as a systemic threat to the economic security of the state. The authors analyze the transformation of the insolvency institution from a market self-regulation tool into a mechanism that fosters monopolization of property, fragmentation of the legal system, and destabilization of the state budget. Key levels of the impact of fraudulent bankruptcies, motivational factors behind illegal activities, and the organizational structure of criminal schemes are described. The study substantiates the need for harmonizing bankruptcy legislation with criminal and administrative enforcement mechanisms, as well as strengthening interagency cooperation to counter adaptive illegal practices. In conclusion, the importance of balancing the protection of bona fide market participants with the suppression of abuses driven by the conflict between public and private interests is emphasized.
